We do not have full insight into the nature or extent of Meta’s data processing and cannot control such processing.

3. Instagram Insights and Joint Controllership

Meta provides us with statistical information about the use of and interaction with our Instagram profile.

This may include aggregated information about reach, views and engagement, as well as demographic information where available and where sufficient data exists.

We generally do not receive complete personal raw data relating to individual profile visitors, but statistical or aggregated information provided by Meta.

Where Meta processes personal data in order to provide such statistics, we and Meta may be joint controllers within the meaning of Art. 26 GDPR in respect of certain processing activities.

Meta provides information on the allocation of responsibilities in its applicable Page or Professional Insights terms.

4. Interactions With Our Profile

If you interact with our Instagram profile, for example by liking or commenting on a post, mentioning us, following our profile or sending us a direct message, we process the personal data that is visible to us in connection with that interaction.

This may include:

• your username and profile information;
• the content of comments and messages;
• the time and type of interaction; and
• any other information you provide to us.

We process this information in order to respond to messages and comments, communicate with users and operate our Instagram profile.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interests include communicating with users and interested persons and managing and presenting our profile.

7. Recipients and International Data Transfers

8. Retention

Personal data processed by us is retained only for as long as necessary for the relevant purpose.

Comments and other public interactions generally remain visible for as long as they remain published on Instagram or until they are removed by you, us or Meta.

Direct messages and other communications may be retained for as long as necessary to deal with the communication or to protect legitimate interests.

We do not have comprehensive control over retention periods for personal data processed independently by Meta.

9. Your Rights

Subject to the applicable legal requirements, you have in particular the following rights:

3. Instagram Insights und gemeinsame Verantwortlichkeit

Wir erhalten grundsätzlich keine vollständigen personenbezogenen Rohdaten der einzelnen Profilbesucher, sondern von Meta bereitgestellte statistische bzw. aggregierte Auswertungen.

Meta stellt nach eigenen Angaben geeignete Mechanismen für internationale Datenübermittlungen zur Verfügung. Dazu können insbesondere Angemessenheitsbeschlüsse und Standardvertragsklauseln gehören. Meta weist selbst darauf hin, dass Informationen zu Datenübermittlungen in die Vereinigten Staaten und zu den dabei eingesetzten Schutzmaßnahmen verfügbar sind. 

8. Speicherdauer

Personenbezogene Daten, die wir selbst verarbeiten, werden nur so lange gespeichert, wie dies für den jeweiligen Zweck erforderlich ist.

Kommentare und sonstige öffentliche Interaktionen bleiben grundsätzlich so lange sichtbar, wie sie auf Instagram veröffentlicht sind oder bis sie von Ihnen, uns oder Meta entfernt werden.

Direktnachrichten und sonstige Kommunikation können gespeichert werden, solange dies zur Bearbeitung der jeweiligen Kommunikation oder zur Wahrung berechtigter Interessen erforderlich ist.

Auf die Speicherdauer personenbezogener Daten, die Meta in eigener Verantwortlichkeit verarbeitet, haben wir keinen umfassenden Einfluss.

9. Ihre Rechte

Soweit die gesetzlichen Voraussetzungen vorliegen, haben Sie insbesondere folgende Rechte:
